These terms govern your use of varifyo.com and any order you place on it. Please read them before you buy. By placing an order you accept them.
Who you are buying from
VARIFYO is operated by iGlomart, LLC, a limited liability company registered in Delaware, United States. iGlomart, LLC is the seller of every piece on this site and is the party answerable for your order. We are an independent retailer. We are not an agent of any fashion house, and nothing here should be read as a statement that a house endorses or is connected with VARIFYO.
Prices and currency
All prices are shown in U.S. dollars. The price displayed is the price you pay: shipping, import duties, customs charges and clearance fees are included and are settled by VARIFYO. Sales tax, where it applies, is shown separately at checkout.
Prices change. We do not show a former price, a recommended retail price or a saving beside a piece: our supplier sends a market price with every item, and we have not verified any of them against what the same model sells for, delivered, elsewhere. Where you see one price, that is the price.
Orders
Your order is an offer to buy. A contract is formed only when we send you an order confirmation. Until then we may decline an order — for example if a piece has sold out, if a price was listed in error, or if we cannot verify the payment or the delivery address. Where we decline, you are charged nothing, and anything already taken is returned in full.
Every piece is sold in the condition stated on its page: new, authentic, with its tags and original packaging.
Payment
Payment is taken at checkout. We do not see or store your card details; they are handled by our payment processor.
Delivery
Delivery times are given as ranges in business days and are estimates, not guarantees: once a parcel is with the courier its progress is outside our control. Our full terms are in the Shipping policy, which forms part of these terms.
Risk in a piece passes to you when it is delivered to the address you gave us.
Returns
You have fourteen days from delivery to tell us you wish to return a piece. The conditions, and what happens when something arrives damaged or incorrect, are set out in the Returns policy, which also forms part of these terms.
Photographs and descriptions
Product photographs and descriptions come from the house or its authorized distributor. Colour varies between screens, and a photograph is a guide rather than an exact likeness. Where a description is wrong in a way that matters, you may return the piece under the Returns policy.
Trade marks
Brand names, logos and product images belong to their owners. They appear here to identify the pieces we sell, as the law permits a retailer to do. VARIFYO claims no rights in them.
Our responsibility to you
We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, nor for business losses.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
Things outside our control
We are not responsible for delay or failure caused by something beyond our reasonable control, including courier disruption, customs action, strikes, severe weather or failures of the payment networks. Where such an event affects your order we will contact you, and you may cancel and be refunded in full for anything not delivered.
Your account
If you create an account, keep your password to yourself and tell us promptly if you think someone else has it. We may suspend an account used for fraud or for anything unlawful.
Privacy
What we collect and why is set out in the Privacy policy.
If you are a consumer in the EU or the UK
We are not delivering outside the United States at present. This section applies from the day we do.
You have fourteen days from the day the parcel is delivered to change your mind, without giving a reason. This is your legal right, and it sits alongside the Returns policy rather than replacing it: where the two differ, whichever is better for you is the one that applies.
To use it, tell us at info@varifyo.com within those fourteen days — a plain sentence is enough, and you do not have to use a form. Send the piece back within fourteen days of telling us. We refund what you paid, including the standard delivery cost if you paid one, within fourteen days of the piece arriving back with us or of your proof that you sent it, whichever comes first, using the same means of payment you used.
The cost of sending it back is yours unless the piece arrived damaged, faulty or was not what you ordered. A piece can lose value if you handle it beyond what is needed to see what it is, as you would in a shop, and we may reduce a refund by that loss.
Nothing in these terms affects your statutory rights, including the right to a remedy where goods are faulty, not as described or not fit for purpose.
If something goes wrong
Write to info@varifyo.com and we will answer. We would rather settle a complaint ourselves than have anyone go further than that. Consumers in the EU may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged to use an alternative dispute resolution body and are not currently signed up to one.
Some necessary small print
- Who may order. You must be at least 18 and able to enter a contract.
- Writing to each other. We will contact you by email about an order. Please keep an eye on it, including the spam folder.
- If one clause fails. If a court finds part of these terms unenforceable, the rest still stands.
- If we do not insist. Not enforcing something straight away does not mean we give it up.
- Transferring the contract. We may transfer our rights and obligations to another business, and will tell you if we do; it will not reduce your rights. You may not transfer yours without our agreement.
- The whole agreement. These terms, with the Shipping, Returns and Privacy policies, are the whole of what is agreed between us about an order.
Changes to these terms
We may change these terms. The version that applies to your order is the one published when you place it.
Governing law
These terms are governed by the laws of the State of Delaware, United States, and the courts of that state have jurisdiction. If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live.
